These terms are the agreement between you and us for using AI1st Radio. They cover the AI1st Radio apps for iOS, iPadOS, macOS, Android and Windows, including the AI1st Radio Teens app, the AI1st Radio Kids app, and the Kids and Teens modes inside the standard app, and our website at ai1st.fm. By using AI1st Radio you agree to these terms. Our Privacy Policy explains how we handle your information.
1.The service
AI1st Radio is a listening app. It includes audiobooks, music, podcasts, live radio stations, and Vibes, which combine visuals, music and ambient sound. It also includes search, and in the standard and Teens apps, optional AI answers.
Where it is available. AI1st Radio is offered in the United States, the United Kingdom, Canada, Australia, New Zealand, Singapore, Bermuda, the Cayman Islands and Gibraltar. Some features and content depend on your country. For example, live radio shows stations from your own country.
The service changes. We add, change and remove content and features over time. Our catalogue is not guaranteed to include any particular title, song, station or episode, and some items may be removed, for example when a licence ends.
Personal use only. AI1st Radio is for your personal, non-commercial use. You may not play it in public venues, businesses or broadcasts.
2.Accounts and eligibility
Using the app without an account. You can use AI1st Radio without signing in. Your device then has an anonymous profile, and your progress and purchases stay tied to that device.
Signing in. You can sign in with Apple or Google. You are responsible for activity under your account and for keeping access to your Apple or Google account secure.
Age. You must be at least 18 to accept these terms and to buy a subscription yourself. If you are 13 to 17, you may use the standard app or the Teens app only with the permission of a parent or guardian, who accepts these terms for you. Teens cannot buy a subscription in the Teens app. They get All Access through a family plan that a parent or guardian manages, as described in Section 4. Children under 13 may use AI1st Radio only through a child profile that a parent or guardian creates, as described in Section 4.
Accurate information. Information you give us, such as a child’s birth month and year, must be accurate, because we use it to choose age-appropriate content.
3.Subscriptions, free listening and billing
3.1 Free listening
Without a subscription you can listen for 15 minutes a day. The allowance resets each day at midnight in your time zone. When it runs out, playback stops until the next day or until you subscribe. Apple Music songs you play through your own Apple Music subscription do not count toward the allowance. We may change the free allowance in the future, and we will show the current allowance in the app.
3.2 All Access plans
All Access gives the people on your plan access to every audiobook, all of our music and every Vibe, with no daily limit. Plans are Individual, Duo, and Family for 3, 4 or 5 people, billed monthly or yearly. A child profile uses one seat. The price, length and number of seats of each plan are shown in the app before you buy. Prices may include tax depending on where you live.
Apple Music content is not part of All Access. To play full Apple Music songs you need your own Apple Music subscription.
3.3 Automatic renewal
Subscriptions renew automatically. Each subscription renews for the same length at the then-current price unless you cancel it at least 24 hours before the end of the current period.
Charges. Payment is charged to your Apple ID account, Google Play account or payment card when you confirm the purchase. Your account is charged for renewal within 24 hours before the end of the current period.
Managing and cancelling. You can manage or cancel your subscription at any time in your store account settings: on iPhone and iPad in Settings › Apple Account › Subscriptions, on Android in Google Play › Payments & subscriptions, and for subscriptions bought on our website in Me › Account › Subscription in the app. Cancelling stops future renewals. You keep access until the end of the period you have paid for.
Free trials and offers. We may offer a free or discounted introductory period, for example the first month free when a friend invites you. At the end of the offer the subscription renews at the regular price unless you cancel at least 24 hours before the offer ends. Any unused part of a free trial ends when you buy a subscription.
Price changes. If the price of your subscription changes, we or the store will tell you in advance, and where the law or store rules require it, you will need to agree to the new price before it applies.
3.4 Refunds
Refunds depend on where you bought your subscription:
App Store. Apple handles all billing and refunds. You can request a refund at reportaproblem.apple.com. We cannot issue refunds for App Store purchases.
Google Play. Google handles billing and refunds under the Google Play refund policies. You can request a refund in Google Play.
Our website (Stripe). Payments are processed by Stripe. You can cancel at any time. Except where the law gives you a right to a refund, payments are not refundable and we do not give refunds for partly used periods. If you think you were charged by mistake, email support@ai1st.fm.
Nothing in these terms takes away any right to a refund or remedy that you have under the consumer law of the country where you live.
3.5 Family plans
The person who buys a Duo or Family plan is the plan owner. The plan owner may invite people to join and may remove them. If the plan ends or the owner deletes their account, everyone on the plan loses the access it gave them.
4.Kids, Teens and parents
Kids. The AI1st Radio Kids app and Kids mode in the standard app are for children under 13. A parent or guardian creates a child profile from their own account and pairs the child’s device by scanning a code. Kids experiences have no ads, no comments, no purchases and no AI answers.
Teens. The AI1st Radio Teens app and Teens mode are for ages 13 and up and show age-appropriate content only. AI answers in Teens are available only after consent, follow stricter content rules and pass an automated safety review. There are no purchases in the Teens app. Teens get All Access through a Duo or Family plan that a parent or guardian manages: the parent pairs the teen’s device with a child profile from the standard app, and the profile uses one seat on the plan.
Parents’ responsibility. By creating a child profile, or by allowing a teen to use AI1st Radio, you confirm that you are the child’s parent or legal guardian and that you accept these terms on the child’s behalf. You are responsible for supervising your child’s use, including which apps and modes they use and any purchases made on devices you control. Leaving Kids mode in the standard app requires a parental check. Keep it private.
Age ratings are a guide. We choose content for each age group with care, but every child is different. You know your child best, and you can remove a child profile at any time.
5.Your content and community rules
In the standard and Teens apps, subscribers can post comments, and anyone can send us feedback. Your content is anything you post or send, including comments, playlists, feedback and reports.
You keep ownership. You own your content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and moderate it for the purpose of running AI1st Radio. For comments, this licence lasts until you delete them or your account.
Community rules. Do not post anything that is illegal, hateful, harassing, threatening, sexually explicit, or violent. Do not post anything that invades someone’s privacy, including another person’s personal information. Do not post spam or advertising, or anything that infringes someone else’s rights. Do not pretend to be someone else, and do not post anything that is harmful to children.
Moderation. Comments are checked automatically by AI moderation models, and anyone can report a comment. We may hide or remove content, and may limit or suspend accounts, when we believe the rules have been broken. We do not have to review every piece of content before it appears, and we are not responsible for content posted by other users.
Things you must not do. You must not copy, record, download or redistribute our audio outside the features we provide, such as offline listening. You must not get around the daily listening limit, subscription checks, region rules or other technical protections. You must not scrape the service or access it with bots, or reverse engineer the apps except where the law allows. You must not interfere with the service or other people’s use of it, or use it to break the law.
6.AI-generated content
AI is part of how we make things. Much of our content is produced with the help of AI. This includes audiobook narration with synthetic voices, podcast episodes and hosts, music, and artwork. Voices in our audiobooks and podcasts are synthetic and do not belong to real people, even when they have names.
AI answers in search. AI answers are optional and are available only in the standard and Teens apps after you turn them on. They are written automatically. They can be incomplete, out of date or wrong, and they are not professional advice (for example medical, legal or financial advice). Check anything important with a reliable source.
Historical and literary works. Many of our audiobooks are classic, public-domain works. They reflect the time they were written in and may contain language or views that are offensive today. Programs about people and history are made to inform. They do not endorse the people or events they describe.
7.Apple Music, radio and other third-party content
Apple Music. If you connect Apple Music, Apple provides the Apple Music content, and your use of it is governed by Apple’s own terms and your Apple Music subscription. We do not control that catalogue, its availability or its pricing. Without an Apple Music subscription, only previews may be available.
Live radio. Live radio stations are operated by the stations themselves. When you listen, your device connects directly to the station’s stream. We do not control what stations broadcast, and a station may stop working or change at any time.
Other services. Links to other websites and services, such as a station’s website or a lyrics source, are provided for convenience. Those services have their own terms and we are not responsible for them.
8.Our content and your licence
AI1st Radio, including the apps, our recordings, narrations, podcasts, music, Vibes, artwork, text, logos and the AI1st Radio name, belongs to us or our licensors. It is protected by copyright, trademark and other laws. Some underlying texts are in the public domain, but our recordings and editions of them are not.
Subject to these terms, we give you a personal, non-exclusive, non-transferable, revocable licence to use the apps and to stream the content for your own personal, non-commercial use. We keep all rights we do not expressly give you.
If you believe something on AI1st Radio infringes your copyright, email support@ai1st.fm. Tell us what the work is, where it appears in AI1st Radio, and how to reach you. We will review the notice and remove material where appropriate.
9.Ending your use and deleting your account
You can stop at any time. You can stop using AI1st Radio at any time. You can delete your account in the app under Me › Account › Delete account, or at ai1st.fm/delete-account. Deleting your account does not cancel a subscription bought in the App Store or Google Play. Cancel it in the store first. The Privacy Policy explains what we delete and when.
We may suspend or end access. We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or to protect other users or the service. Where it is reasonable, we will tell you why and give you a chance to respond.
If we stop the service. If we stop offering AI1st Radio, we will give reasonable notice in the app. For subscriptions bought on our website, we will refund the unused part of any prepaid period.
10.Disclaimers and limits of liability
We work hard to keep AI1st Radio running well, but we provide it “as is” and “as available”. To the extent the law allows, we do not promise that it will always be available, uninterrupted or error-free. We also do not promise that any content, including AI-generated content, will be accurate, complete or suitable for a particular purpose.
To the extent the law allows, we are not liable for any indirect or consequential loss, or for loss of data, profits or opportunity. Our total liability to you for any claim about AI1st Radio is limited to the greater of the amount you paid us for the service in the 12 months before the claim, or £50 (or the equivalent in your local currency). Where you bought through Apple or Google, the amount you paid includes what you paid through that store.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded by law. Nothing in these terms affects your statutory rights as a consumer. If you are a consumer, you may have rights that cannot be changed by contract. These rights include the rights under the UK Consumer Rights Act 2015, the Australian Consumer Law, the New Zealand Consumer Guarantees Act, and Canadian provincial consumer protection laws.
11.Governing law and disputes
These terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction. If you are a consumer, you can also bring proceedings in the courts of the country or state where you live. The mandatory consumer protection laws of that place also apply to you.
If you have a problem, please contact us first at support@ai1st.fm. Most issues can be solved quickly that way.
12.App store terms
12.1 Apps downloaded from the App Store
If you downloaded AI1st Radio from Apple’s App Store, the following also applies:
These terms are between you and us, not Apple. We, not Apple, are responsible for the apps and their content.
Your licence to use the apps is limited to Apple-branded devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
Apple has no obligation to provide maintenance or support for the apps.
If an app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the apps.
We, not Apple, are responsible for handling any claims about the apps. These include product liability claims, claims that an app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. We are also responsible for investigating, defending and settling any claim that an app or your use of it infringes someone else’s intellectual property rights.
You confirm that you are not located in a country that is subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12.2 Apps downloaded from Google Play
If you downloaded AI1st Radio from Google Play, your purchases are also subject to the Google Play Terms of Service. Google is not responsible for the apps or their content.
13.Changes, language and contact
We may update these terms, for example when we add features or when the law changes. We will post the new version on this page and update the effective date. If a change is significant, we will tell you in the app before it takes effect. If you keep using AI1st Radio after the change, you accept the new terms. If you do not agree, you can stop using the service and cancel your subscription.
If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
Language. These terms are available in English and in Canadian French. If you live in Quebec, the French version prevails if the two versions differ. Everywhere else, the English version prevails. If you live in Quebec and choose to read and accept the English version, you confirm that you were first given the French version and that it is your express wish to be bound by the English version.
